DeskBuddy Terms of Service

These terms govern your use of the DeskBuddy desk calendar device's software and the online services that support it (together, the "Services"). DeskBuddy is a product of Blueberry Consultants Ltd ("Blueberry", "we", "us"), a company registered in England. By setting up a DeskBuddy or using the Services you agree to these terms.

The purchase of a DeskBuddy device from our store is covered by the terms of sale presented at checkout on thedeskbuddy.com; these terms cover the software and online services only.

DeskBuddy displays calendars from third-party providers (currently Microsoft and Google). When you link an account:

3. Licence

We grant you a non-exclusive, non-transferable licence to use the DeskBuddy firmware on the DeskBuddy device it is installed on. The firmware and Services, including their design and branding, remain the property of Blueberry or its licensors. You must not misuse them — for example by attempting to disrupt the pairing or update services, probing them for vulnerabilities you do not have permission to test, or using them to access accounts you are not authorised to access.

4. Availability of the online services

The pairing and firmware update services are provided free of charge to support your device, and we may change, suspend or discontinue them. DeskBuddy is designed so that day-to-day operation talks directly to your calendar provider: an outage or withdrawal of our online services would prevent linking new accounts or fetching updates, but calendars already linked continue to work.

5. Sensible reliance

DeskBuddy is a convenience display. Meeting alerts depend on your network, your calendar provider and your device's clock, so please do not rely on DeskBuddy as your only reminder for anything important.

6. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under the law of England and Wales. If you are a consumer, these terms do not affect your statutory rights, including your rights under the Consumer Rights Act 2015.

Subject to the above, the Services are provided "as is"; we are not liable for losses caused by events outside our reasonable control, for loss of profit or business, or for losses arising from missed or incorrectly displayed calendar entries, and our total liability in connection with the Services is limited to the amount you paid for your DeskBuddy device.

7. Changes to these terms

We may update these terms from time to time — for example when we add features or providers. The current version will always be at pair.thedeskbuddy.com/terms.html, with the "last updated" date above. If a change is significant we will highlight it on this page or through the device's release notes.

8. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute — although if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
